I just can’t leave the idea alone. The more I let it bore into my brain, the more it seems like a tenable solution to so many problems.
So I did what I do, and started thinking through it some more. I guess we should talk about what a Constitution should look like. Here is where I started.
Constitution of the United States of North America (USNA)
Preamble We, the peoples of North America, in pursuit of unity, prosperity, justice, environmental stewardship, and democratic freedoms, hereby establish this Constitution to ensure liberty, equality, and wellbeing for all.
Article I: Structure of Government
Section 1: Legislative Branch
- The legislature shall be tricameral, consisting of:
- People’s House: Members directly elected every two years, with one representative for every 500,000 adults. Districts are determined based on reported income ranges, grouping constituents with similar income levels.
- Statehouse Representatives: Members elected proportionally within states/provinces every four years.
- Governors’ Assembly: Comprised of the elected executives (Governors or equivalents) of each state/province, elected according to each state’s process.
- Legislature is responsible for drafting, debating, and passing laws.
- Legislature maintains authority over government finances, budgets, taxation, and expenditures (“power of the purse”).
Section 2: Executive Branch
- A Chief Administrator (President) shall be elected directly by a majority vote of all three houses of the legislature in joint session.
- The Chief Administrator serves an 8-year term unless recalled by a concurrent vote of 50.1% in each house of the tricameral legislature.
- Executive duties include providing concurrence or denial on judicial promotions as recommended by the judiciary.
- Executive branch oversees national defense and military forces, ensuring the security of the republic and coordinating defense strategies.
Section 3: Judicial Branch
- The judiciary operates independently, with judges hired, trained, and promoted by the Department of Law (DOL).
- Judges serve for life, with mandatory retirement set at the average retirement age of the general population, monitored and adjusted periodically by the legislature.
- Judges select candidates for promotions through peer evaluation, subject to concurrence or denial by the executive branch.
- Legislature may not nominate, promote, or directly deny judicial promotions.
Section 4: Constitutional Amendments
- Amendments require a 50.1% majority in each legislative house, administrative approval, and judicial review.
Section 5: General Lawmaking
- Laws require a simple majority (50.1%) in each legislative house, the executive signature, and a judicial review to ensure constitutional compliance.
Bill of Rights
- Natural Equality
- All humans are created equal with inherent dignity, deserving equal rights and protections under the law.
- Freedom of Thought and Expression
- The right to freely express ideas, beliefs, and opinions through speech, press, peaceful assembly, and petition.
- Privacy and Security
- Protection against unreasonable surveillance, search, seizure, and intrusion by the government into private lives.
- Justice and Due Process
- Right to fair treatment, impartial justice, timely trials, and the presumption of innocence until proven guilty.
- Democratic Participation
- Universal and equal suffrage and participation in free and fair elections without discrimination.
- Education
- Right to access quality education, vocational training, and lifelong learning opportunities equally available to all.
- Healthcare
- Universal access to necessary healthcare, preventive medicine, and emergency care without undue financial hardship.
- Economic Security
- Guarantee of essential human needs including adequate food, clean water, and basic shelter as a foundation for individual dignity and social stability.
- Environmental Stewardship
- Right to live in a clean, healthy, and sustainable environment, with government responsibility to protect and sustainably manage natural resources.
- Transparency and Information
- Guaranteed access to government information and transparency in public institutions.
- Corporate Accountability
- Corporations must operate with transparency, accountability, and respect for the public good, bound by clear constitutional standards.
Constitutional Amendment Procedure
- Any amendment requires a separate, clearly defined proposal, approval by a simple majority (50.1%) of each legislative house, executive approval, and confirmation of constitutional compliance by the judiciary.
Checks and Balances
- Clearly defined separation of powers with robust checks and balances among all branches to prevent authoritarian consolidation and maintain a representative, transparent government.
Final Note
- This constitution remains open to amendment to adapt to societal evolution, emphasizing democracy, equality, regional representation, and sustainability as core guiding principles.
